Dear customers,

I am writing to you as President of KIMERA GAMESOFT SAS to inform you with the utmost regret of the permanent closure of our business. This decision, made after a thorough analysis of our financial situation, is due to our inability to continue providing sufficient funding to the company, making further operations impossible.

Despite our efforts, we are deeply sorry that we are unable to honor all of your pending payments or orders.

We sincerely apologize for this disappointment. Creating memorable experiences for players like you was our passion, and we are sorry we were unable to fulfill our ambitions.

The court-appointed liquidator will contact you. He will be responsible for making partial repayments of the sums owed to you, according to the legal distribution he will make among the creditors.
You can also declare your claim to the court-appointed liquidator by providing an invoice and proof of payment.
We will provide you with the contact details of the liquidator appointed by the Bordeaux Commercial Court as soon as the proceedings begin. The deadline for filing a claim is two months from the date of publication of the judgment opening the liquidation proceedings in the BODACC (Official Bulletin of Civil and Commercial Announcements).

We sincerely apologize for this situation, which in no way reflects our usual commitment to you. Your trust has been invaluable to us, and we deeply regret this inconvenience.

Sincerely,

David Fortier

I'm sure that they knew that this was bound for failure a LONG time ago. We all know that there are little to no funds to reimburse anyone foolish enough to have pre-ordered this vaporware. That money is long gone. The fact that people have to go chase after their money instead of this company reimbursing its customers is proof enough. A partial refund means like $1.25 out of $500 for those lucky enough to get anything back.

In the future, if you truly believe in your product, then go out and get a real investor instead of fleecing the public with bullshit "pre-orders." A real investor will light a fire under your ass with a time frame with expectations to make sure that they get a return on their investment. Then you can place orders on a FINISHED product in a reasonable time frame.

If the ROM is going into a black hole somewhere, the company should consider releasing it under an open source license and maybe the public can make something good of it should they choose.

They’ve put the company into judicial liquidation. That means the manager has been replaced by a court-appointed liquidator whose job is to sell off all of the company’s assets to repay debts in order: first the tax authorities, then employees, then the bank, then suppliers — and finally, at the very end, the customers. Under the law, customers are considered the lowest priority in this kind of situation.

In other words, the game’s development will never continue in any form, and not a single customer will ever get a refund. The statement about “partial refunds” is completely false.

It’s obvious they siphoned off all the preorder money — at least $52,000. There was absolutely no reason to launch preorders at that stage of development, and no reason to touch that money either. This was a straight-up scam.

I wonder from what money they wanted to produce the actual carts from. Those things are not cheap.
In reality, apart from the production costs, they didn't really make much money left for actually paying someone to code or create assets.
Certainly not enough to keep any kind of company afloat for more than two weeks.

We could keep an eye out on French auction sites, see if the liquidation comes up.
But unless they are retarded most useful assets have been moved to the private estate before applying for bankruptcy. One wonders why they turned it in an actual company before getting at least some product out.

I know quite a few good people who did, and supported the project 😟
... No, not just Frenchmen and Belgoobians, before anyone asks.
I dunno why but that game had bad vibes from the beginning. Kinda like that Pony sth game. Totally different to for example your stuff.

The way they announced the project with almost no information didn't sit right. We didn't even know the genre. It also came amid too many other indie game announcements for the Neo.
