New and Unsealed games: Opinions?

Reads like I'm going to burst out into one of those incomprehensible OCD rants, but, this is more about principle tbh.

I recently bought a PS3 game off everyone's preferred international auction site. The picture displayed was a sealed copy of the game and the description states 'new'. Foolishly (key), not paying attention, I bought the game as the price was decent and within what I wanted to pay (£10 delivered).

Anyway, fast forward to receipt of said item and the game in question, isn't sealed. I was prepared to go onto ebay and provide the seller with his due mouthful. However, upon scrutinising the description more closely, it DOES say 'unsealed'... but the image used is clearly misleading as it shows a sealed copy.

So, what's the point in discussing all this?

I just wanted your opinion:

If you buy a PS3, PS4 or even PS2, SNES, DC etc game and it states "New and Unsealed"...

Do YOU consider that to be "New" or 2nd hand in Mint Condition?*

*Contextual to the format the games were released on, of course (i.e. MD titles only ever had a sticker on the spine, for example sans an official seal/wrap)

Like, when you go into a games store to buy a new game and they take an opened copy out of a draw and put it in the box for you. I consider that game opened by someone else, thus, 2nd hand...

I consider new and unsealed to be a purposefully misleading description - new "but" unsealed would be the correct way to describe it, the eye sees what it's expecting to see which they new when they listed it.

Other than that I don't really give a shit if I'm intending to open it myself - yes I'd be a bit annoyed if I bought what I expected to be a brand new game and when I got it the cellophane was open, but I know myself, and there's no way I could be bothered to do anything about it providing the game worked and was otherwise as new.

In general - new and unsealed is not new.

Lots of people open stuff and so long as they haven't actually used it yet(or feel it's in good enough condition to pass as 'un-touched'), will still consider it new. Yes, they all suck. You have a case though so give this p.o.s. seller hell

"New" should only be applied to things where you can verify they have never been used (factory seal, usually). There are things that were never factory sealed (famicom carts, for instance) therefore I'd say it's not correct selling them as new, more like used but mint or something.

Everything has to have some kind of state that it's "new" in though, whether that's a sealed wrapping or whatever.

New and unsealed are mutually exclusive terms. You only get to pick one. You can say "Like New" or never played/used but it's generally agreed upon that New implies receiving it in the packaging it was originally shipped to market in.

Your fault for not reading the description thoroughly enough but I'd go after that scummy seller anyway. Dishonest shady people deserve what they get.

I get a kick out of people trying to pass off re-shrink wrapped games as new/sealed, especially when you can see other auctions of the game with a manufacturer's seal on the top and a y-fold cellophane wrapper.

New but unsealed doesn't work in our society as it becomes a matter of trust, therefore, as GAMEFAN has stated, it's not new if you aren't the first person to open it up.

Everytime I trade my turds at EBgames to get new Wii U or PS4 games, they always try to give me one of their opened copies. I usually tell them that what they're doing is pretty much illegal here in Qc. You should see the priceless reactions I get sometimes. I love trolling these hipster faggots, you have no idea

The hilarious bit is that they always get those printed sleeves to use as marketing materials and fill out endcaps. It's a sign of an idiot in management that can't see it makes their jobs easier to use those and not have to got games, make storage space for them, or deal with irate customers who hate the practice to begin with.

New means in the retail condition, as you would expect NOS. But I know most people don't change the right fields, especially the condition one. So then if the item received does not equal the photo, then you can file a claim. If you do not want to pay return shipping, file a partial claim. But for $20 (or 10 pounds of funny money) who cares?

Year ago when I worked for Electronics Boutique (PS1 era) we received display boxes for every new game that game out. The problem would be that there wasn't a good, efficient way of managing what was in your actual inventory (from a customer perspective) when there were display boxes on the floor. We had to deal with irate customers demanding that we sell them games that simply weren't in stock. Having to remember to pull down or put back up display boxes to match actual inventory was equally time consuming.

Gutting product was a more cost effective, efficent way of dealing with the issue (not that I particulary liked it).

People don't know what rare means. If I can search eBay and find a copy at any time, that's not rare. It might be uncommon, but nothing you can see on a regular basis for sale can be rare, by definition. Drives me mad too.

I am one OCD having motherfucker when it comes to games...especially when I would fork out the $$ to get a new game.

Places like GameStop can fuck off with their opening new games...that is some fucking bullshit. Popping their shitty stickers all over everything and putting the disc in a sleeve in a drawer. The fist time I saw that, I told him to cancel the sale, I went to Wal Mart and got a copy there. I have never bought a game from them since.

Years back...River City Ransom came out for the GBA and for the life of me, it was damn near impossible to find. No place had a copy...anywhere. I was forced to go to Game stop and wouldn't you know...those motherfuckers had one copy left...and they opened the damn thing. Man, I was pissed about that (still am...actually).

If I ever step foot in a gamestop again, it will be too soon.

That isn't even the full explanation. You can certainly have items that do not show up on Ebay and they still wouldn't be rare. This is often difficult for video games because everyone sees it as a cash cow, so they toss everything and anything video game related on Ebay. It happens more-so with Computer games, which is still overlooked.
