In all seriousness, I'd honestly like to see this actually go to court. I have the feeling that this would be an interesting precedent, and be one cool and relevant (to me) court case. Man! The idea of suing someone over something on an internet forum is interesting.

And yeah I love legal loopholes. Heh, one time my mom was posting on this singles forum (and fyi she's a widow so nothing wrong), and she and my grandma got pissed off when I called up her posts and looked at them. I explained to them that she made the choice to post them on the internet to a public forum that anyone can read, so there's really nothing wrong with what I'm doing. Oh ho ho they were pissed that I was right.

LOL... that bullshit never flies in court, especially for most torts (a "tort" is a civil case for damages [money, etc] as opposed to a criminal case for incarceration or fines. What you described is tort.).

She could try to do an intentional infliction of emotional distress (IIED), but no court would take it seriously. They would tell her to grow tougher skin: "if you give a letter to someone you could probably fathom that they might show it to people. If that makes him a jerk, fine -but we're not going to let you sue him because that would open up courts to a ton of frivilous cases... like this one."

Defamation doesn't work because nothing Spike Spiegal wrote down was a lie. In fact, nobody knows who she really is because Spike Spiegal editted out all the identifying marks from his first posting of the picture.

Those are the only two torts that fly under your theory, frostbanyeaucti, and they're dead on arrival. (thank god for all of us, this is too fun)

Naw, if that case went to an actual court (or charges were filed) there would be plenty of organizations like the ACLU or internet-related orgs that would probably supply legal defense free of charge.

As far as the same handwriting issue goes, if you look at top right section of the document there is a box checked off indicating that the TRO is being "Independently Processed", which I am assuming means that the ex-GF is the one doing all the paperwork. Most places have forms for people to fill out their own forms for less complicated court stuff like small claims and TRO's. And it'd be an elaborate trick to go so far as to include a "filed" stamp date on the front of the document.

And I don't know about Illinois, but in Hawaii, the restraining order process goes like this:

1. ex-GF will file a petition with a judge saying that there is a threat of imminent harm by the ex-BF.

2. A judge will look at the petition and see if the petition is believeable and if the judge finds that there is a threat, the temporary restraining order will be granted based solely on the ex-GF's story.

3. Next the ex-GF and ex-BF will get a court date about two weeks later for a full hearing, where both sides get to tell their sides of the story.

4. Judge decides whether or not to grant request for a more permanent restraining order.

If the ex-BF, who is the supposed threat, does not show, he will be in default and the a more lenghty restraining order may be ordered in his absence. And while you won't be breaking any laws by not showing up, as far as I know TRO info is public knowledge and people will see this if they decide to look at court records.

This kind of stuff happens a lot between people who have had relationships and this is really an abuse of the process. She might be able to stop you from posting the note in a different way, like a civil suit similar to the ones where the celebs try to get people not to post unflattering pics of them, but that would probably cost a lot more. I haven't read the whole thread, but as far as I can tell, ex-GF and her friends and family are the ones intiating all contact and making all of the demands. I'm not saying what you did was tasteful or smart, but it wasn't enough to get a TRO. I don't see where the perceived threat of harm is and you should check to see if there is any sort of penalty for wasting people's time like this.

I'd just like to reiterate my earlier point that no judge in his or her right mind would decide that posting a picture of a letter about a vagina on the internet fits this criterion AT ALL.
